These Terms of Service (“Terms”) govern your access to and use of the website, services, communications, and related offerings provided by Your Legacy Your Story (“Company,” “we,” “us,” or “our”). By accessing our website, submitting information, requesting services, or engaging with us in any manner, you agree to be bound by these Terms.

2. Services

Your Legacy Your Story provides digitization, organization, archiving, and storytelling services for analog media, including but not limited to photographs, slides, negatives, film, videotapes, audio recordings, and related materials (“Media”).
Services may include intake consultation, organization, digitization, enhancement, digital delivery, physical return of originals, and optional storytelling or presentation formats.
All services are provided on a project basis. We do not sell subscriptions.

3. User Responsibilities

By engaging our services, you represent and warrant that:
  • You own or have legal rights to all Media you submit
  • You have authority to request digitization or reproduction
  • Submitted Media does not violate copyright, privacy, or other rights
  • Information you provide is accurate and current
You acknowledge that digitization involves handling aging, fragile, and irreplaceable materials.

4. Handling of Original Media & Risk Disclosure

You acknowledge and agree that:
  • Submitted Media may be fragile, degraded, or damaged due to age or prior storage conditions
  • Reasonable care will be taken, but digitization inherently involves some risk
  • Pre-existing damage may worsen during handling despite best practices
Your Legacy Your Story is not responsible for loss or damage caused by:
  • Pre-existing deterioration
  • Normal handling during digitization
  • Manufacturer defects in original media
  • Acts of God, fire, flood, or power events
  • Third-party shipping carriers
Clients are strongly encouraged to maintain independent backups and insurance coverage where applicable.

5. Shipping & Delivery

If you choose to ship Media to or from us:
  • Shipping is at your own risk unless otherwise agreed in writing
  • We are not responsible for carrier delays, loss, or damage
  • Tracking and insurance are the client’s responsibility unless explicitly included

6. Payment Terms

  • Payment terms are defined in your project agreement or invoice
  • Services may require deposits or full payment prior to delivery
  • Failure to pay may result in project suspension or delayed delivery
  • All sales are final once services have been rendered

7. No Guarantees

While we strive for high-quality results, no specific outcome is guaranteed, including:
  • Image or audio quality
  • Completeness of recovery
  • Compatibility with future technology platforms

8. Limitation of Liability

To the maximum extent permitted by law:
  • Our total liability shall not exceed the amount paid for the specific service
  • We are not liable for indirect, incidental, consequential, or emotional damages
  • We are not responsible for loss of sentimental or historical value
Some jurisdictions do not allow certain limitations; where prohibited, limitations apply to the fullest extent allowed.

9. SMS Messaging & A2P Compliance

By submitting your phone number through our website, intake forms, lead forms, or by providing it verbally or in writing, you expressly consent to receive SMS messages from Your Legacy Your Story, which may include:
  • Appointment confirmations
  • Project updates
  • Follow-up communications
  • Customer support messages
  • Marketing or promotional messages (where applicable)
Messaging Disclosures:
  • Message frequency may vary
  • Message and data rates may apply
  • Consent is not a condition of purchase
Opt-Out:
You may opt out at any time by replying STOP to any SMS message.
For help, reply HELP or contact us directly.
Your information will not be sold or shared for third-party marketing purposes.

10. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

11. Intellectual Property

All website content, branding, text, graphics, and materials created by Your Legacy Your Story remain our intellectual property unless otherwise agreed in writing.
Clients retain ownership of their original Media and resulting digital files, subject to payment completion.

12. Termination

We reserve the right to refuse or terminate services at our discretion, including for:
  • Nonpayment
  • Misrepresentation
  • Abuse of staff
  • Illegal or unethical use of services

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Any disputes shall be resolved in a court of competent jurisdiction located in California.

14. Changes to Terms

We may update these Terms from time to time. Continued use of our website or services constitutes acceptance of any revisions.
